Trump DOJ Launches Investigation into Pardons Issued by Biden
The Trump administration’s Justice Department is reviewing pardons and commutations issued by former President Joe Biden during the final weeks of his presidency.
Justice Department Pardon Attorney Ed Martin is leading the review.
Officials have confirmed that the list of individuals granted clemency by Biden is under examination.
The review follows concerns about Biden’s mental condition during his last months in office and his use of an AutoPen to sign official documents.
It remains unclear which specific clemency cases are being reviewed. However, reports indicate the Justice Department is focusing on preemptive pardons granted to Biden’s son, Hunter Biden, as well as commutations for more than 35 death row inmates.
These commutations reduced their sentences to life in prison.
The Department of Justice did not respond to Fox News’s inquiries about the scope or timeline of the review. Officials also declined to clarify whether the investigation is limited to certain individuals or categories of offenses.
Biden issued a total of over 1,500 pardons and commutations near the end of his term, as Fox News reported.
The White House at the time described the action as the largest single-day clemency order in U.S. history.
Some recipients of clemency had been convicted of large-scale financial crimes, including defrauding the federal government and taxpayers of tens of millions of dollars. The inclusion of such individuals in the clemency list drew criticism from political opponents and legal experts.
Among the most controversial were preemptive pardons for Hunter Biden and other individuals closely associated with the president. These decisions are now under renewed scrutiny as the DOJ review proceeds.
The use of the AutoPen to sign documents, including pardon proclamations, has also come under examination. Critics argue that its use raises questions about Biden’s direct involvement in the clemency process.
White House officials had previously defended the use of the AutoPen, stating that the device was used in accordance with established legal protocols and that each decision had the president’s approval.
Following the 2024 election, in which President Donald Trump returned to office, Republican lawmakers called for a review of Biden’s final executive actions. The clemency orders were among the items prioritized for examination.
Congressional Republicans have requested documentation and internal memos related to Biden’s pardon decisions. The DOJ has not yet confirmed whether it will cooperate with these requests.
The investigation does not currently involve criminal charges or formal allegations of wrongdoing. It is classified as an internal review led by the Office of the Pardon Attorney.
Officials say the review is focused on determining whether proper procedures were followed and whether Biden was in a condition to lawfully exercise presidential clemency powers.
The Biden-era clemency orders are being compared with prior administrations to assess whether any significant deviations occurred. The Trump administration has not announced any plans to reverse or revoke any of the pardons at this time.
Legal analysts say the outcome of the review could influence future clemency standards and presidential procedures.
The Justice Department has not indicated when the review will be completed or whether its findings will be made public.
