Five Aborted Babies Found in DC – Now GOP Lawmakers Demand Answers From FBI

Two Republican lawmakers are demanding federal action in a controversial case involving the discovery of five aborted babies outside a Washington, D.C. abortion clinic.

The case, dubbed the “D.C. Five,” has stirred national attention since 2022, and now Reps. Chip Roy (R-TX) and Andy Biggs (R-AZ) are pressing the FBI to investigate potential violations of federal law.

In a letter sent Tuesday to FBI Director Kash Patel, Roy and Biggs urged the bureau to reexamine its previous decision not to pursue the case.

They allege that the Biden administration and local authorities, including D.C. Mayor Muriel Bowser, failed to enforce existing laws designed to protect unborn children and infants who survive abortion procedures.

The remains of the five babies were discovered in March 2022 by pro-life activists outside the Washington Surgi-Clinic, a facility known for performing late-term abortions.

The activists claimed they recovered the bodies during what they described as a rescue operation.

Images of the fetuses, some of which appeared to be developed enough to survive outside the womb, sparked outrage among pro-life organizations and lawmakers.

The disturbing nature of the discovery immediately raised questions about whether federal abortion-related laws had been violated.

Pro-life groups, citing the physical condition and developmental stage of the babies, have long suspected the possibility of illegal late-term abortion procedures.

Some even believe that one or more of the babies may have been born alive and then left to die, which would be a direct violation of federal law.

Roy and Biggs questioned the FBI’s inaction under former Director Christopher Wray and the Biden-Harris administration in their letter, accusing them of abandoning their responsibility to enforce the law.

“Under the Biden Administration and the tenure of former Director Christopher Wray, the Federal Bureau of Investigation (FBI) departed from its core public safety mission, suffered from senior leadership failures, and refused any real transparency or accountability for its actions,” the letter stated.

Roy and Biggs are not only raising questions—they are also taking action.

As chairs of the Subcommittee on the Constitution and Limited Government and the Subcommittee on Crime and Federal Government Surveillance, respectively, the two lawmakers say they are now conducting an inquiry into how the District of Columbia is enforcing two key federal laws: the Partial-Birth Abortion Ban Act of 2003 and the Born-Alive Infants Protection Act of 2002.

The Partial-Birth Abortion Ban Act prohibits a specific type of late-term abortion procedure that involves partially delivering a fetus before termination.

The Born-Alive Infants Protection Act requires medical care to be provided to any infant born alive during an attempted abortion.

The lawmakers expressed concern that these laws have been neglected.

“We write to request that the FBI review the decision not to move forward with an investigation and the Biden Harris’s apparent decision not to enforce the Partial-Birth Abortion Act and the Born Alive Infants Protection Act,” they wrote.

Pro-life advocates have maintained that the D.C. Five could represent clear examples of these laws being violated.

The lack of federal investigation to date has only intensified calls for action.

Roy previously urged the Department of Justice in November 2024 to preserve all evidence related to the D.C. Five, but those requests, he says, went unanswered.

Findings from a new investigation, according to Life News, could support efforts to repeal the Freedom of Access to Clinic Entrances (FACE) Act.

Pro-life advocates argue that the FACE Act has been misused to prosecute non-violent demonstrators while shielding abortion clinics from scrutiny.

“Roy and Sen. Mike Lee have both introduced legislation to repeal FACE, advocating for Congress to protect pro-life voices and ensure accountability within abortion facilities,” Life News reported.
