Tyler Robinson Could be Set Free Over Major ‘Flaw’ in Kirk Assassination Case

A top Utah attorney is raising serious concerns about the case against Tyler Robinson, the 22-year-old accused of assassinating conservative leader Charlie Kirk.

Robinson allegedly fired the single shot that struck Kirk in the neck as he spoke to students at Utah Valley University on September 10. Prosecutors say the murder was carefully planned, but a veteran defense lawyer now warns that a flaw in the evidence could upend the case.

Skye Lazaro of Ray Quinney & Nebeker told Fox News, “There’s just so much we don’t know yet as this case develops.”

Discovery in the case began this week with prosecutors facing a five-day deadline to disclose initial evidence. Robinson’s defense has already delayed his waiver hearing for another month, giving his attorneys more time to examine the state’s evidence.

Charging documents already revealed incriminating text messages.

Prosecutors allege Robinson described the killing in detail to his “transgender romantic partner” and admitted it in a group chat with friends.

Robinson was arrested 33 hours after the assassination. He allegedly confessed to his father before a youth pastor convinced him to turn himself in.

Before surrendering, Robinson reportedly returned to the crime scene, coming face-to-face with an officer near where the rifle was later recovered. The timing of that encounter could prove critical, per Trending Politics.

Lazaro said, “If it doesn’t line up in a way that makes sense, it could definitely be bad for them.”

Robinson told the officer he was retrieving something left near a parking garage. Thousands had fled the campus during the chaos, leaving behind belongings, so the officer initially found nothing suspicious.

But investigators later traced Robinson’s license plate from that encounter. Lazaro warned the case could hinge on whether the officer’s bodycam was active. “If the officer’s bodycam was not on, it could provide an opening for Robinson’s defense,” she said.

Text message subpoenas may become another key battle. Lazaro explained, “A lot of times, what you can get when you subpoena cellphone records are where messages were sent from.”

If data confirms the texts originated in Orem near the crime scene, prosecutors will argue it matches their timeline. Lazaro said the defense will work aggressively to dissect that timeline with forensic experts.

Robinson’s roommate and partner, 22-year-old Lance Twiggs, is cooperating with prosecutors. Lazaro suggested the defense will attempt to discredit his statements.

Some conspiracy theories have circulated about the case, including claims that messages were fabricated. Lazaro cautioned, “Unless you absolutely know and can prove that something like that happened, that’s not the greatest defense. I think you tend to lose credibility unless you really can substantiate it.”

Robinson faces an aggravated murder charge carrying the death penalty. He has not yet entered a plea. His next hearing is scheduled for October 30 in Provo, but delays are likely.
