NY Supreme Court Strikes Down Voting Law – Over 800,000 Non-Citizens Won’t Be Allowed to Vote in Municipal Elections

Election integrity is a hot topic in America today, and will get even hotter as we roll towards the midterm elections in November and the presidential election in 2024.

Many citizens remain concerned that our system isn’t 100% reliable, with rumored reports of deceased residents “voting” and miscounted ballots. There’s also the issue of non-citizens voting in elections.

But now, people who are illegally in this country won’t get a chance to cast a ballot in New York.

Back in December 2021, the New York City Council created a class of voters called “municipal voters.” Basically, it let all non-citizens who’d been in the city for at least 30 days before an election register to vote.

Republicans quickly seized on this as another ploy to allow illegal residents to have a say in U.S. elections.

This law would’ve let “municipal voters” to participate in multiple important elections, including those for mayor, public advocate, comptroller, borough president and council member.

However, the state Supreme Court decided that this can’t be allowed.

The New York Supreme Court ruled Monday that a New York City law that allowed noncitizen residents to vote in municipal elections is illegal.

Richmond County Supreme Court Judge Ralph Porzio said that the state Constitution “explicitly lays the foundation for ascertaining that only proper citizens retain the right to voter privileges.”

This affects anywhere between 800,000 and 1 million people in the state, which in turn has a drastic impact on voting and elections in the future.

Previously, former Mayor Bill de Blasio and current Mayor Eric Adams neither signed nor vetoed the bill; de Blasio had concerns because there were “big legal questions” surrounding it.

He was also worried that it would only give non-citizens more incentive to remain illegal, and not pursue legal citizenship.

This ruling comes after the Republican National Committee and New York Republican State Committee joined individual voters to sue city officials over the law. At the time, they said it directly violated the state’s Constitution.

In this case, the high court agreed. Judge Porzio added:

It is clear to this Court that voting is a right granted to citizens of the United States.

He further cited New York Election Law section 5-102(1), which clearly states that “no person shall be qualified to register for and vote at any election unless he is a citizen of the United States.”

In the end, Porzio concluded that the City of New York doesn’t have any authority to issue laws allowing non-citizens to vote, which is precisely what most right-wing politicians have been saying for years.

At the same time, many Democrats continue to push for the “illegal vote,” as others call it.

But with so many people illegally in the United States, it seems clear that this has a massive impact on our elections — and it appears to go against just about every law of the land we currently have.
