Federal Judge Hands Down Major Ruling in Trump FBI Case – Delivers Biden’s DOJ a Loss, Approves Donald’s Pick For Special Master

Immediately after the FBI conducted an unprecedented raid of former President Donald Trump’s Mar-a-Lago estate, the political world flew into an uproar.

Democrat leaders jumped at the chance to condemn the GOP firebrand, while others called the move “politically motivated.” Some even say the partially released affidavit shows there’s “no case” against Trump.

That won’t stop the case from proceeding — but it will proceed partly in Trump’s favor.

The former POTUS wanted a special master appointed by the courts, rather than allowing the Department of Justice (DOJ) to have free reign to analyze the documents removed from Mar-a-Lago.

While the government has the right to review classified documents seized in an FBI raid, Trump’s defense lawyers maintained that they also had a right to request a special master.

Now, a federal judge has granted them this request. On top of that, she has approved one of Trump’s picks for the position.

This news is bound to have a tremendous impact on how people view the case, as Trump supporters will undoubtedly applaud the decision. The Biden administration has yet to comment, though.

From Fox News:

A federal judge denied the Department of Justice’s motion for a partial stay to allow the use of classified documents obtained during an FBI raid on Donald Trump’s Mar-a-Lago residence and appointed a special master picked by the former president.

The ruling comes from U.S. District Court Judge Aileen Cannon, who selected Raymond Dearie to be the special master in the case.

Dearie is a judge for the Eastern District of New York, and he’s also the one the DOJ said they would approve for the job. So in this way, both sides should be partially satisfied with the decision.

Judge Dearie now has until November 30 to complete the review of the documents.

He’s a former Foreign Intelligence Surveillance Court judge, and he must “provide the Court with a scheduling plan setting forth the procedure and timeline for concluding the review” within 10 days.

All this being said, Trump’s team is responsible for all Dearie’s expenses in this task.

Said Judge Cannon as part of her ruling:

The Court does not find it appropriate to accept the Government’s conclusions on these important and disputed issues without further review by a neutral third party in an expedited and orderly fashion.

The DOJ is currently investigating whether Trump violated the Espionage Act by taking classified documents away from Washington. For his part, Trump says he declassified all materials.

The government initially appealed the court order of a special master, but this latest decision sounds like the DOJ will have to accept Dearie.

The public’s reaction to the raid has been mixed, and some are now calling for the resignation of FBI director Christopher Wray. Others say it only happened to keep Trump from running in 2024.

We won’t get any definitive answers until after the midterm elections are over, but expect there to be plenty of interest when the courts finally pass down a ruling on the Trump/FBI case.

Key Takeaways:

  • A federal judge denied the DOJ’s motion for a stay, and appointed a special master in the Trump case.
  • The selection is one of Trump’s choosing, and also one the DOJ said they would accept.
  • The special master has until November 30 to complete his official review of the alleged classified documents seized during the FBI raid.
